The state parliament of Lower Saxony has officially expanded its public smoking ban to include e-cigarettes, vapes, and vaporized cannabis. This legislative update ensures that vaping is now strictly prohibited in venues like restaurants and hospitals, aligning with existing rules for traditional combustible cigarettes.
Previously, the statewide ban explicitly applied only to traditional smoking, which already included smoking cannabis joints. However, e-cigarettes and heated tobacco products were exempt from these restrictions. The newly passed reform, spearheaded by the governing SPD and Green factions with support from the CDU, effectively closes this loophole.
The updated legislation now explicitly bans the following in designated non-smoking areas:
- Electronic cigarettes and vapes
- Heated tobacco products
- Cannabis vaporizers
Lawmakers from the SPD and Green parties justified the expansion by highlighting that secondhand vapor is potentially harmful to public health. Furthermore, they argued that allowing the widespread use of vapes in non-smoking areas threatens to undermine the societal “paradigm shift towards non-smoking” that previous legislation aimed to achieve.
