The Ukrainian parliament has passed legislation banning flavored vaping products and prohibiting vape advertising and public use. This move, aimed at reducing youth vaping, aligns Ukraine with World Health Organization recommendations and European Union regulatory baselines.
Aligning Ukrainian Law with European Union Directives
The ban on non-tobacco vape flavors will take effect on July 11, 2023. Although Ukraine is not an EU member, the country committed to aligning its national laws with EU standards under a 2017 bilateral agreement. This process requires Ukraine to use the EU Tobacco Products Directive (TPD) as the baseline for its domestic vaping regulations.
Ukraine is the sixth European nation to restrict flavored e-cigarettes, joining several others with similar policies:
- Estonia, Finland, and Hungary: Restrictions on non-tobacco flavors are already active.
- Denmark: A flavor ban takes effect April 1, 2022.
- The Netherlands: A flavor ban is scheduled for July 1, 2022.
The Impact on Ukraine’s Smoking Population
Public health advocates have questioned the timing of the restrictions. The 2017 Global Adult Tobacco Survey revealed that more than 20 percent of Ukrainian adults smoked daily. Critics argue that removing flavored options will make it harder for adult smokers to switch to lower-risk nicotine alternatives.
Prior to December 2020, Ukraine had no laws preventing minors under 18 from purchasing vaping products or heated tobacco products (HTPs). The new legislation represents a rapid shift from unregulated sales to some of the strictest vaping controls in Europe.
