Germany Approves Steep E-Liquid Tax Ahead of EU Directive

New legislation taxes all e-liquids, including zero-nicotine, threatening vape shops and setting a precedent for the EU.

The German government has officially passed the Tobacco Tax Modernization Act, introducing a sweeping tax on all e-liquids beginning July 1, 2022. Approved by both the Bundestag and Bundesrat, the legislation targets both nicotine-containing and nicotine-free e-juices, drastically increasing consumer costs and threatening the survival of the country’s 1,500-plus vape shops.

The tax will be implemented in stages, creating a significant financial burden for Germany’s large community of “steamers” (vapers). For a standard 10 mL bottle of e-liquid, consumers will face an immediate price hike of approximately 30 percent next year.

Implementation YearTax Rate (per mL)Estimated Price Increase (10mL Bottle)
July 2022€0.16 ($0.19 USD)~30%
2026 (Maximum)€0.32~60%

Because the legislation explicitly includes zero-nicotine products, retailers cannot avoid the tax by selling separate nicotine-free shortfills and nicotine shots. Industry experts anticipate this will force many brick-and-mortar stores out of business, inadvertently driving consumers toward cross-border online retailers and the black market.

This aggressive taxation strategy arrives despite Germany’s high smoking prevalence, with more than 22 percent of Germans over age 15 smoking cigarettes. The new bill also raises traditional cigarette taxes and introduces taxes on heated tobacco products (HTPs) like IQOS at rates comparable to combustible tobacco.

Germany’s new rates will place it among the highest-taxed nations for vaping in Europe, though it still falls short of Montenegro’s massive €0.90/mL levy.

European CountryE-Liquid Tax Rate (per mL)
Montenegro€0.90
Germany (by 2026)€0.32
Finland & Portugal€0.30
Denmark (Upcoming)~€0.27

The timing of Germany’s tax is highly critical as the European Union reassesses its harmonized tobacco tax framework, the Tobacco Excise Directive (TED). The European Commission is currently considering a minimum tax rate for vapor products across all 27 member states.

As the richest and most populous EU nation, Germany’s steep tax could set a concerning precedent. A powerful push from Germany for a high EU-wide minimum tax would prevent German vapers from seeking cheaper alternatives in neighboring countries. Meanwhile, health authorities in Spain are already advocating for their own e-liquid tax, signaling a broader regulatory tightening across Europe.
