The Argentinian Ministry of Health has officially published Resolution 549/2026, signaling a historic pivot in the nation’s public health strategy regarding tobacco and nicotine. By replacing an outright ban on heated tobacco with a highly restrictive regulatory framework, the government aims to dismantle the illicit market and gain oversight over products that have already seen a 35.5% consumption rate among high school students.
This regulatory shift acknowledges that total prohibition failed to stop the proliferation of unregulated devices. Under the new guidelines, the state transitions from a hands-off ban to intensive fiscalization, monitoring the chemical composition, safety, and marketing of all alternative nicotine products entering the country.
The National Registry of Tobacco and Nicotine Products (RPTN)
At the center of the new policy is the creation of the National Registry of Tobacco and Nicotine Products (RPTN). This mandatory database will track and authorize every device and substance sold in Argentina. The registry divides products into five distinct categories:
- Electronic cigarettes (devices)
- E-liquids (vape juice)
- Heated tobacco devices
- Heated tobacco “sticks” or cartridges
- Nicotine pouches
To obtain registration—which is valid for five years—manufacturers and importers must submit exhaustive technical dossiers. Requirements include complete chemical formulas with toxicological data, laboratory emission certificates, and proof of prior approval in at least one country with recognized regulatory standards. Additionally, companies must pay a registration fee equivalent to the retail value of 2,000 premium cigarette packs.
Strict Product Standards and Nicotine Caps
To discourage youth initiation, Resolution 549/2026 imposes severe restrictions on product design, flavors, and nicotine content. Disposable vapes are completely prohibited, forcing a transition to reusable systems. Furthermore, characterising flavors are banned, restricting products to tobacco flavor, with a sole exception for menthol in nicotine pouches.
The table below outlines the maximum nicotine concentrations and flavor restrictions allowed under the new law:
| Product Category | Maximum Nicotine Limit | Permitted Flavors |
|---|---|---|
| E-liquids / Vape Juice | 20 mg/ml | Tobacco only |
| Nicotine Pouches | 8 mg per unit | Tobacco and Menthol |
| Heated Tobacco Sticks | 5 mg per unit | Tobacco only |
The regulations also ban the addition of active or stimulating ingredients, such as caffeine, taurine, or other vitamins, as well as any known carcinogenic or toxic additives.
Packaging, Marketing, and Enforcement
Packaging requirements have been heavily overhauled to prevent youth appeal. All product packaging must feature child-proof opening mechanisms and prominent health warnings covering 50% of the front and back covers.
Crucially, packaging must display the mandatory disclaimer: “Este producto NO ha sido avalado para dejar de fumar“ (This product has NOT been approved for smoking cessation). Manufacturers are strictly forbidden from using terms like “tobacco-free” or any marketing language suggesting these products carry a reduced health risk compared to traditional smoking.
The Ministry of Health will enforce these measures through periodic factory and importer inspections, product recalls for non-compliance, and severe penalties for false declarations. Companies are also required to maintain all technical documentation for a minimum of five years and submit regular reports on sales volumes and consumer demographics to help the state refine its policies over time.
