The Dutch government has officially finalized its long-delayed prohibition on all non-tobacco vaping flavors. Published in the official government gazette, the new regulations mandate a complete phase-out of flavored e-liquids by October 2023, directly threatening the survival of the country’s independent vaping industry through severe ingredient restrictions.
Following a final public consultation, the rules were officially cemented in the Staatscourant on November 28, 2022. The comprehensive ban applies to all nicotine-containing and zero-nicotine e-liquids, encompassing bottled vape juice, pre-filled pods, and disposable devices.
To facilitate the transition, the government has established a strict phase-out timeline:
- July 1, 2023: All manufacturing of non-tobacco flavored vape products must stop.
- September 30, 2023: The final day retailers are permitted to sell existing flavored stock.
- October 1, 2023: The total retail ban on non-tobacco flavors takes effect.
Beyond the flavors themselves, the law introduces aggressive marketing restrictions. According to Dutch public broadcaster NOS, manufacturers are prohibited from using any words or images on packaging that refer to anything other than tobacco. Trendy naming conventions, such as “OMGin” or “chillin,” will be strictly outlawed.
The most controversial aspect of the new law is the heavily restricted ingredient list. Public health institute RIVM has approved just 16 ingredients that manufacturers can use to formulate tobacco flavors. While the government claims that 25 percent of current tobacco flavors can be recreated using this list, the vaping industry vehemently disagrees.
Emil ‘t Hart, chairman of the vaping trade association Esigbond, stated that initial tests of e-liquids made with the allowed flavorings resulted in a “very weak copy” of actual tobacco. Because essential flavor components are banned, Esigbond warns that 80 percent of its members expect the rules to shut down their businesses, as they will be unable to legally reformulate their products.
The push for a flavor ban began in 2020 under former Health Minister Paul Blokhuis. The initiative relied heavily on a government-commissioned study by the Trimbos Institute, which claimed flavors lower the threshold for youth vaping and act as a stepping stone to combustible cigarettes.
Implementation was originally slated for July 2022 but was postponed after Esigbond alerted authorities that several ingredients on the RIVM’s initial approved list were known carcinogens. With the revised list now finalized, the Netherlands joins a growing list of European nations—including Denmark, Estonia, and Finland—that have enacted strict flavor restrictions.
