The Tax and Customs Authority of Portugal has officially prohibited the sale of all tobacco products and e-cigarettes containing CBD, THC, or other cannabinoids. Disclosed in an official letter dated November 26, 2025, the directive aligns market controls with medical regulations, effectively ending the commercial sale of recreational cannabis-infused smoking products.
The decision stems from a binding opinion issued by Infarmed, Portugal’s National Authority of Medicines and Health Products. Under Decree-Law No. 8/2019, the cannabis plant and its derivatives are classified strictly as controlled substances. Consequently, they can only be legally distributed for therapeutic purposes by businesses holding an Infarmed-issued Marketing Authorization (MA).
This regulatory shift heavily impacts the retail market, particularly goods subject to Tobacco Tax. By enforcing these strict medical standards, authorities have closed the legislative “gray area” that previously allowed retailers to sell cannabinoid-infused items.
The ban directly targets several popular product categories, including:
- Traditional cigarettes infused with cannabis
- Pre-rolled hemp joint products
- E-cigarette liquids (vapes) containing CBD or THC
With this directive, any product containing plant extracts must now comply with Portugal’s stringent medicinal market requirements, removing them entirely from regular tobacco trade channels.
