The Spanish government is advancing its 2026 Anti-Tobacco Law, which will prohibit smoking and vaping inside all vehicles used for professional purposes. This regulation aims to expand smoke-free spaces and directly impacts thousands of professional drivers across the country.
Affected Vehicles and Vape Regulations
Once the law is officially published, the ban will cover taxis, VTCs, freight transport, and shared company vehicles. The law treats electronic cigarettes—regardless of whether they contain nicotine—exactly the same as traditional tobacco products.
Fines and License Penalties
Drivers caught smoking or vaping in a shared company vehicle will face a €200 fine. However, unlike the penalties for throwing cigarette butts out of a window, this infraction will not result in a loss of driver’s license points. Professional drivers must prepare to adjust their daily work habits ahead of the official publication.
