Poland vape ban, nicotine-free vapes Poland

The Polish government has officially approved a draft amendment to its national tobacco protection act, paving the way for a total ban on the sale of all e-cigarettes and refill containers to individuals under the age of 18. Spearheaded by the Ministry of Health, the legislation specifically targets the rapid rise of vaping among young people by eliminating the legal loophole for nicotine-free products.

Under current laws derived from the EU Tobacco Products Directive (2014/40/EU), only nicotine-containing e-liquids are heavily regulated. The new Polish amendment seeks to bridge this gap, treating “nicotine-free liquids” with the same severity as standard e-cigarettes. Health officials argue that non-nicotine vapes pose a comparable public health threat, acting as an easy gateway for non-smokers and youth to transition to nicotine addiction.

Once enacted, the new regulations will impose several strict limitations on nicotine-free vaping products, aligning them with traditional tobacco regulations:

  • Underage Sales Ban: A complete prohibition of sales to anyone under 18 years old.
  • Usage Restrictions: Vaping nicotine-free liquids will be banned in the same public spaces where nicotine vaping is currently prohibited.
  • Distribution Bans: A total ban on sales via vending machines and distance/online shopping.
  • Marketing Ban: Complete prohibition of advertising and promotional campaigns.
  • Mandatory Registration: All products must be officially reported to the Bureau for Chemical Substances.

The draft bill has been forwarded to the European Commission for the mandatory EU notification process. Following its official domestic announcement, the law is slated to take effect after a three-month transition period. Additionally, manufacturers and distributors of nicotine-free liquids already on the market will have a six-month grace period to register their products with the President of the Bureau for Chemical Substances.
