Elf Bar Hungary ban, Bensons Europe fine

The Hungarian Competition Authority (GVH) has imposed a maximum fine of HUF 38.7 million (EUR 100,177) on Slovakian-registered distributor Bensons Europe s.r.o. This decisive action follows an investigation into online shops misleadingly suggesting that e-cigarettes and Elf Bar products could be legally ordered in Hungary.

The penalized firm, based in Párkány, Slovakia, repeatedly obstructed the investigation by failing to provide mandatory information, resulting in an initial HUF 3 million (EUR 7,765) fine. Furthermore, when authorities ordered an interim shutdown of the Hungarian-language webshop, the company attempted to circumvent the block by migrating its domain to a different hosting provider. This prompted daily escalating enforcement fines until the site was permanently offline.

Why Hungary Has Banned Elf Bars

Elf Bars – disposable, battery-operated devices pre-filled with flavored nicotine or nicotine-free e-liquid – are strictly illegal in Hungary. Originally inspired by American JUUL products and manufactured in China, these devices flooded European markets following tighter restrictions in Australia.

Hungarian regulators have flagged these products as highly dangerous due to several factors:

  • Youth Appeal: Bright colors and sweet flavors are strategically designed to attract children and minors.
  • High Addiction Risk: High nicotine concentrations facilitate rapid chemical dependency among young users.
  • Unregulated Quality: The devices contain untested, unreliable, and completely unknown chemical compositions.

A Multi-Agency Coalition Against the Black Market

Because Elf Bars are banned, distribution has shifted to aggressive underground networks. In response, Hungarian authorities established a dedicated anti-Elf Bar coalition. This joint task force includes the GVH, the Ministry of the Interior, the National Tax and Customs Administration (NAV), and the National Police.

Through coordinated enforcement, authorities have successfully cleared illegal vape sales from the immediate vicinity of schools and public institutions. NAV alone has conducted hundreds of targeted operations to purge these products from the market.
